KVKK Disclosure

This notice is provided by Novax as data controller, in accordance with the Turkish Personal Data Protection Law no. 6698 ("KVKK"), to inform you about how your personal data is processed.

1. Data Controller

Novax ("Novax", "the Company"), acting as data controller, makes the following disclosures pursuant to Article 10 of KVKK.

2. Personal Data Processed

We collect the following personal data through the contact form on our website:

  • Full name
  • Email address
  • Phone number (optional)
  • Subject and message content you submit

3. Purposes of Processing

  • Responding to your contact requests
  • Conducting partnership, investment and commercial discussions
  • Evaluating feedback and complaints addressed to the Company
  • Fulfilling our legal obligations

4. Legal Basis

Your personal data is processed under Article 5 of KVKK; the principal legal bases are:

  • Direct relevance to the conclusion or performance of a contract (Art. 5/2-c)
  • Necessity for the legitimate interests of the Company (Art. 5/2-f)
  • Compliance with our legal obligations (Art. 5/2-ç)
  • Where none of the above applies, your explicit consent (Art. 5/1)

5. Transfer

Your personal data is not shared with third parties except in the limited circumstances below:

  • Email delivery infrastructure: We use Resend, Inc. (United States) to relay messages submitted through the contact form so that we can respond to you. This constitutes a cross-border data transfer under Article 9 of KVKK and relies on your explicit consent.
  • Authorised public bodies, where required by law.

6. Retention

Your personal data is retained for the period necessary to handle the contact request and afterwards for a maximum of 2 years to serve as evidence in any potential commercial dispute. After this period or once the legal need ceases, your data is deleted, destroyed or anonymised.

7. Data Subject Rights (KVKK Art. 11)

You may apply to the Company to exercise the following rights regarding the processing of your personal data:

  • Learn whether your personal data is being processed
  • Request information regarding the data processed
  • Learn the purpose of processing and whether the data is used in line with that purpose
  • Know the third parties to whom data has been transferred domestically or abroad
  • Request correction of incomplete or inaccurate data
  • Request deletion or destruction under the conditions of KVKK Art. 7
  • Request that correction/deletion be communicated to third parties
  • Object to a result reached solely through automated analysis that produces an adverse outcome
  • Claim compensation if you suffer damage due to unlawful processing

8. How to Apply

To exercise the rights above, please send your request to support@novaxlim.com or to our postal address. Requests are answered free of charge within 30 days at the latest. A reasonable fee may be charged where conditions of the Data Controllers' Registry Regulation are met.

If your request is rejected, you find our response insufficient or you do not receive a reply within the legal deadline, you retain the right to file a complaint with the Personal Data Protection Authority.
